CUSTOMER PRIVACY POLICY

Dear Customer,
In accordance with Legislative Decree No. 196/2003 (personal data protection code - hereinafter referred to as "Code"), A. Menarini Diagnostics S.r.l., as Data Controller, hereby informs you of the following scopes and methods of the processing of your personal data:

1. Scopes and methods of data processing
The personal information you provided with your order and with the coupon contained in the instrument’s packaging will be exclusively used for carrying out our contractual obligations and to respond to your requests in this regard, and in particular:

  • for entering your personal data in the company's database;
  • for the keeping of accounts;
  • for contractual obligation fulfillment and post-sales support, including customer assistance and guarantee implementation;
  • to comply with the requirements established by the regulations and Community rules relating to contracts and consumer protection, and to fulfill tax obligations.

The purposes listed above do not require the transfer of personal data classified as "sensitive" under the Code (for example, information pertaining to the state of health or possible illnesses). In the event that you should incidentally provide such sensitive data, it will not be recorded or preserved for the protection of your privacy, in conformity with the purposes set out above.
Personal data will be processed using electronic and non-electronic means as foreseen by the personal data protection provisions and in particular by the security measures under Sections 31-35 and under Annex B of the Code, and by observing all cautionary measures that ensure confidentiality and security.

2. Nature of data collection and consequences of failure to grant consent
Although providing your personal data is discretionary, it is necessary in order to comply with the contractual and, in general, legislative obligations. Failure to provide consent of processing your personal data could therefore render it impossible for us to fulfill our contractual obligations. Furthermore, your consent is not required for the processing of data necessary to perform the obligations resulting from the contract of which you are a party, according to Section 24 of the Code.

3. Communication and dissemination of data
For contractual obligation performance and for the purposes outlined above, your personal data may be communicated to company employees and/or collaborators of A. Menarini Diagnostics S.r.l., specifically designated as Data Processors under Sections 29 and 30 of the Code. Entities entrusted by the Data Controller with outsourcing activities or services instrumental or functional to the purposes above, specifically nominated Data Processors under Sections 29 and 30 of the Code, can also become aware of your personal data. For specific technical or administrative requirements related to the objectives listed above, or in compliance with legal obligations, your data may also be shared with other companies of the Menarini Group which may also be located abroad and outside the European Union. In such cases, we confirm that your privacy will be protected under the Code on the basis of the appropriate agreements and contractual guarantees.
Your personal information will not be disclosed unless required by law or regulation or by Community legislation.

4. Rights of the Data Subject
At any time you may exercise your rights with the Data Controller as provided for in the Code. In particular, you may request to obtain: confirmation as to whether or not personal data concerning you exist; communication of such data and their origin in intelligible form without delay; the erasure of data (subject to conservation requirements for contractual, accounting and tax purposes); the anonymization or blockage of data; the updating, rectification or integration of data; certification to the effect that the mentioned operations have been notified to the entities to whom or which the data were communicated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. You shall have the right to object, whole or in part, on legitimate grounds, to the processing of personal data concerning you, even though they are relevant to the purpose of the collection.You may exercise your right to access the data by sending written communication via registered letter to the Data Controller or Data Processor at the address indicated in point 5 below or by sending an e-mail to servizioclienti@menarini.com (please specify "Privacy" in the subject line).

5. Data Controller and Data Processor
The Data Controller is A. Menarini Diagnostics S.r.l., with registered offices in Florence (Italy), Via Sette Santi n. 3. The Data Processor is the General Manager in Italy who can be contacted at the registered offices of A. Menarini Diagnostics S.r.l..
An updated list of all data processing managers is available at the registered office of the Data Controller and will be provided upon written request.
